Yes, you can, because this commission is abusive and its cancellation means that the money should be reimbursed. The banks justify this payment because they must ask the details of the applicant and of guarantors from the Risks Centre of the Spanish Bank (CIRBE) and analyse and study those details, just the same as what happens with the property bankruptcy files, they have to request and review the documentation that confirms the financial capacity of applicants and guarantors.

They must also request the survey of the property that needs to be mortgaged, the bank needs to elaborate and submit a risk proposal for approval from the risk committee and finally, they must draw the contract and contact the notary to regularise the operation. But in truth, the opening commission isn't charged for real services or fees and it cannot be justified either as a fee for the loan because the contract for the loan is done when the money is transferred and there are financial conditions to the loan (various kinds of interests) for their payment. .
